In addition to the demands and intimidation of court, the Washington State Department of Licensing has an important and powerful role in most every DUI.  Bellingham attorneys can most certainly advise you properly but there are some important and time sensitive matters that you must be aware of immediately.

The first is that you only have 7 days to submit the DOL driver’s hearing request form to the DOL.  Upon receipt of the request, with the $375, you will receive a package that includes the DOL hearing date and police report. The DOL hearing is held on the telephone and four issues are to be decided, which are:

  • Was there a lawful basis to stop and/or contact the driver
  • Was there probable cause to arrest the driver
  • Were the Implied Consent Warnings advised to the driver properly
  • Was the breath, blood test or refusal of same, valid.

​​Should you lose the DOL hearing you will lose your privilege to drive.  Such a suspension will be for no less than 90 days and could be substantially longer.  If this occurs you are able to obtain an Ignition Interlock License that will permit you to drive.  We strongly recommend you do not do the DOL hearing without the assistance of a good Whatcom County DUI attorney.  The DOL hearing is tricky and focused on technical legal procedures.  They are difficult enough so do whatever you can to reduce your risk.  Only an experienced Whatcom County DUI lawyer can do this.
